Preface

Civil Code of the Peoples Republic of China is a milestone legislation as it is the first law promulgated with the name of Code since the establishment of the Peoples Republic of China，and it is an important achievement of developing the socialist rule of law with Chinese characteristics for a new era.By improving the lawbased governance，it will help create an enabling environment for business and further unleash Chinas economic potential.In particular，with the highlight of a peoplecentered philosophy，the Code will play a pivotal role in protecting peoples rights and interests，developing Chinas human rights cause as well as modernizing the countrys governance capacity.

Letting the rest of the world know better about the Civil Code is a significant way to facilitate the communication of Chinas legal system with foreign countries and regions.Thus，the Standing Committee of the National Peoples Congress and its Legislative Affairs Commission （LAC） attach great importance to the translation of the Code to make it reach the rest of the world.

Acknowledgments.In the translation process，we were confronted with many challenges due to the difference of the two languages and some concepts that only exist in Chinas legal system.It is difficult，therefore，to complete the translation within a limited time period.It would be impossible to find a way out without the efforts by the Expert Team for the Translation of the Civil Code under LAC，including Gao Lingyun，Chen Weizuo，Jiang Junlu，Tong Xiaohua，Li Mingqian，Ma Jing，Zhang Falian，Xia Jihong，Da Ji，Mao Yu and Chengzhou Ludan.We are grateful for their contributions in the translation，especially for their efforts in offering constructive suggestions on legal terms and making the translation more idiomatic.We also wish to express our sincere thanks to all the persons and organizations that contributed to the publication of this book.

Special Notes to Readers.This translation is for reference only.In case of discrepancy between the English translation and the original Chinese text，the Chinese edition of the Code shall prevail.Besides，to make the text concise，we decided to use the thirdperson singular male pronouns to include the corresponding female and neuter pronouns except where the context dearly requires otherwise.

《中華人民共和國民法典》（以下簡稱《民法典》）是中華人民共和國成立以來部以“法典”命名的法律，是新時代中國特色社會主義法治建設的重大成果，具有裡程碑意義。《民法典》在中國特色社會主義法律體繫中具有重要地位，是一部固根本、穩預期、利長遠的基礎性法律。《民法典》的頒布與實施對全面推進依法治國、加快建設社會主義法治國家，對發展社會主義市場經濟、鞏固社會主義基本經濟制度具有重大意義；在堅持以人民為中心的發展思想、依法維護人民權益、推動我國人權事業發展以及推進國家治理體繫和治理能力現代化方面發揮舉足輕重的作用。

做好《民法典》的海外宣傳介紹工作，是推進我國法律制度對外宣傳和交流、講好中國立法故事的一項重要舉措。更好地將《民法典》介紹給世界，是增進中國同世界上其他國家和地區法律體繫間交流的重要方式。因此，全國人大常委會及其法制工作委員會領導高度重視《民法典》的翻譯和對外宣介工作。
